Inco Hit With $36M Verdict Over Nickel Emissions

Law360, New York (July 7, 2010, 4:03 PM EDT) -- Vale SA affiliate Inco Ltd. has been pounded with CA$36 million ($34 million) in damages for a nickel refinery's discharge of emissions near an Ontario community, marking Canada's largest environmental class action award to date.

Judge Joseph Henderson of the Ontario Superior Court of Justice on Tuesday handed down judgment in favor of the plaintiff class of Port Colborne, Ontario, residents.

Inco's discharge of nickel did not amount to a public nuisance, but did amount to a private nuisance, Judge Henderson ruled.
