2nd Circ. Axes Pratt & Whitney Plans To Move Facilities

Law360, New York (July 8, 2010, 4:30 PM EDT) -- A federal appeals court has upheld an order barring the Pratt & Whitney division of United Technologies Corp. from moving two Connecticut facilities out of the state, holding that doing so would violate a collective bargaining agreement with its employees.

The district court's permanent injunction prohibiting the company from implementing the plans to move the facilities during the term of the CBA, which ends later in 2010, is valid, a three-judge panel in the U.S. Court of Appeals for the Second Circuit ruled Thursday.
