Law360, New York (July 09, 2010, 4:27 PM ET) -- Delaware's highest court has refused to hear CNX Gas Corp.'s appeal of a ruling that its shareholders have legitimate claims in their breach of fiduciary duty suit seeking to block Consol Energy Inc.'s $960 million plan to acquire the remaining shares of the coalbed methane gas producer.
The issues raised in CNX's application for an interlocutory appeal should be addressed after the entry of a final judgment, a three-judge panel of the Delaware Supreme Court ruled Thursday.
