9th Circ. Chucks Beach Boy's Spat With UK Paper

Law360, New York (July 8, 2010, 6:32 PM EDT) -- A federal appeals court has shot down founding Beach Boys member Mike Love's appeal of his loss in a suit against a British publication and other entities for using his likeness, ruling that neither the Lanham Act nor California’s common law right of publicity apply extraterritorially in the case.

Claims under either law are not viable for the events in question that occurred in Britain, a three-judge panel ruled in the U.S. Court of Appeals for the Ninth Circuit on Thursday.
