Law360, New York (July 13, 2010, 2:25 PM ET) -- A New Jersey state appeals court has affirmed the dismissal of a lawsuit against Pfizer Inc. and a number of its predecessors that alleged a polio vaccine administered over 40 years ago caused a brain tumor.
A three-judge panel of the Superior Court of New Jersey, Appellate Division, ruled Monday that a Bergen County court was right to dismiss the suit because the original manufacturer of the vaccine couldn't be identified and the plaintiffs didn't provide sufficient evidence to float a collective liability theory.
