NYC OTB Commission Spat Could Go To State Board

Law360, New York (July 13, 2010, 3:41 PM EDT) -- A judge is weighing whether to allow racetrack owners Finger Lakes Racing Association and Empire Resorts Inc. to go to a state racing board with contract-related disputes over bankrupt New York City Off-Track Betting Corp.’s alleged failure to pay certain commissions.

Following a hearing Tuesday in the U.S. Bankruptcy Court for the Southern District of New York, Judge Martin Glenn asked the debtor and the track owners to submit additional briefings, noting that his ruling could have significant ramifications for the state’s racing industry.
