Nestle Unit Reaches FTC Accord Over Boost Ads

Law360, New York (July 14, 2010, 2:38 PM EDT) -- A subsidiary of Nestle SA has agreed to drop allegedly deceptive advertising claims about the health benefits of its popular children's drink Boost Kid Essentials, part of a settlement resolving the Federal Trade Commission's first case challenging advertising for probiotics.

Under the terms of the proposed settlement, announced by the FTC on Tuesday, Nestle HealthCare Nutrition Inc. has agreed to stop claiming the drink will reduce the risk of colds, flu and other upper respiratory tract infections unless that assertion is backed up by the U.S....
