BNSF Could Be On Hook For Tougher Lead Standards

Law360, New York (July 15, 2010, 3:12 PM EDT) -- A federal judge has denied summary judgment to BNSF Railway Co. in a Superfund suit that opens the possibility for a polluter that has already completed environmental cleanup to be forced to perform a more stringent remediation if a state agency later raises its standards.
