Law360, New York (July 16, 2010, 12:07 PM ET) -- A federal magistrate judge has ordered Terminix International Co. to enter arbitration with pest technicians who allege that the exterminator failed to pay them overtime compensation, despite the exterminator's claims that the plaintiffs had waived their right to arbitrate.
Magistrate Judge Douglas E. Miller of the U.S. District Court for the Eastern District of Virginia on Thursday granted the plaintiffs' motion to stay their Fair Labor Standards Act collective action and ordered Terminix to submit to arbitration.
