Law360, New York (July 19, 2010, 4:31 PM ET) -- A federal appeals court has revived a suit rodenticide maker Reckitt Benckiser Inc. filed alleging the U.S. Environmental Protection Agency was attempting to ban certain rodenticides without giving companies a chance to challenge the agency's policies.
The U.S. Court of Appeals for the District of Columbia Circuit remanded the case Friday, saying the district court had improperly thrown out the lawsuit for lack of jurisdiction.
