Aspex Loses Appeal In Dispute Over Eyewear Patent

Law360, New York (July 21, 2010, 5:30 PM EDT) -- A federal appeals court has affirmed the dismissal of Aspex Eyewear Inc.'s counterclaims against rival Revolution Eyewear Inc. in a patent infringement suit over magnetically attached auxiliary eyewear.

In a one-page ruling issued Wednesday without an opinion, the U.S. Court of Appeals for the Federal Circuit affirmed the lower court's decision to dismiss the claims for lack of jurisdiction and deny Aspex attorneys' fees.
