11th Circ. Allows 4,000 Tobacco Claims To Head To Trial

Law360, New York (July 22, 2010, 7:41 PM EDT) -- A group of smokers and their families won a closely watched appeal Thursday that allows about 4,000 federal death and injury claims in Florida against U.S. tobacco companies such as R.J. Reynolds Tobacco Co. and Philip Morris USA Inc. to move to trial.

The U.S. Court of Appeals for the Eleventh Circuit vacated a pre-trial order from a lower court, which had blocked the plaintiffs' ability to rely at trial on certain findings previously established in a related class action.
