FTC Gaining High Ground In Pay-For-Delay Fight: Chair

Law360, New York (July 27, 2010, 1:44 PM EDT) -- Despite facing setbacks in the fight to block pay-for-delay patent settlements, Federal Trade Commission Chairman Jon Leibowitz told lawmakers Tuesday that the "tide may be turning" in the courts and vowed to pursue more cases over the deals to keep generic drugs from entering the market.

In the first nine months of fiscal year 2010, there have already been 21 settlements in which brand-name pharmaceutical companies offered generics makers some sort of compensation, Leibowitz said, more than in any previous fiscal year.
