NJ Law To Apply In Malicious Prosecution Suit V. Biovail

Law360, New York (July 27, 2010, 5:46 PM ET) -- A federal judge has ruled that New Jersey law will apply in a malicious prosecution action Gradient Analytics Inc. has brought against Canadian pharmaceutical company Biovail Corp., which previously sued the stock researcher for issuing unflattering reports about the company.

Judge Frederick Martone of the U.S. District Court for the District of Arizona said Monday that New Jersey law should govern the case and denied Biovail's motion to dismiss the suit, finding Gradient had adequately pled that it suffered harm from two 2006 lawsuits Biovail lodged...
