Weight-Loss Pill Fraud Class Action Eighty-Sixed

Law360, New York (August 5, 2010, 3:43 PM EDT) -- A federal judge has thrown out a putative class action accusing Metabolic Research Inc. of duping consumers into spending tens of millions of dollars each year on purported weight-loss products that are actually worthless.

Judge Valerie Baker Fairbank of the U.S. District Court for the Central District of California ruled Wednesday that she did not have jurisdiction in the case because the amount in controversy through the claims, brought pursuant to the Class Action Fairness Act, did not exceed $5 million.
