Vt. State Workers' OT Action Survives Dismissal Bid

Law360, New York (August 06, 2010, 1:05 PM ET) -- A federal judge has refused to dismiss a putative collective action accusing Vermont of failing to pay overtime wages to higher-grade employees, ruling that the state workers did not have to show they were not exempt from federal wage laws at this stage.

Judge William K. Sessions III of the U.S. District Court for the District of Vermont denied the state's motion to dismiss the Fair Labor Standards Act suit Thursday, saying that the 72 employees had adequately pled their case.
