Judge Calls For New Trial In Fresenius Case

Law360, New York (February 13, 2007, 12:00 AM EST) -- Medical device maker Fresenius Medical Care will again face allegations that it infringed Baxter International Inc.’s patents covering a hemodialysis machine now that a federal judge has ordered a new trial in the case.

Following a post-trial briefing, Judge Sandra Brown Armstrong found Monday in the U.S. District Court for the Northern District of California that a jury based its invalidity findings of Baxter’s patents on unsubstantial evidence.
