Teva Avoids Injunction In Alcon's Vigamox IP Suit

Law360, New York (August 9, 2010, 4:44 PM EDT) -- A federal judge has denied a request by Alcon Inc. to impose a permanent injunction that would prevent Teva Pharmaceuticals USA Inc. from working on a generic version of Vigamox before a patent covering the anti-bacterial eye drop drug expires in 2019.

Having previously determined that Teva's abbreviated new drug application infringed an Alcon patent for the drug, Judge Sue L. Robinson of the U.S. District Court for the District of Delaware on Thursday denied the plaintiff's motion to amend the judgment to include an injunction....
