EEOC's Race Bias Suit Survives Propak's Dismissal Bid

Law360, New York (August 10, 2010, 2:05 PM EDT) -- A judge has refused to toss a lawsuit brought by the U.S. Equal Employment Opportunity Commission accusing freight management company Propak Logistics Inc. of not hiring qualified non-Hispanic employees for a Wal-Mart Stores Inc. distribution facility in North Carolina.

Judge Martin Reidinger of the U.S. District Court for the Western District of North Carolina on Friday rejected Propak's contention that the EEOC had failed to state a claim in its August 2009 complaint.
