Law360, New York (August 16, 2010, 6:46 PM ET) -- A federal appeals court has upheld an arbitration award in favor of tortilla maker Gruma SA de CV, which was accused of breaching contracts and failing to pay proper wages to its drivers.
Though the plaintiffs successfully argued that California law provides the standard for vacatur in this circumstance, they failed to demonstrate that the arbitrator violated the state's disclosure rules or exceeded his powers, according to a three-judge panel of the U.S. Court of Appeals for the Ninth Circuit.
