Fed. Circ. Revives Transocean IP Case Against Maersk

Law360, New York (August 18, 2010, 7:01 PM EDT) -- A federal appeals court has revived Transocean Offshore Deepwater Drilling Inc.'s infringement suit against Maersk Contractors USA Inc. over three offshore drilling patents, issuing a finding that a trial court erred in sinking the case.

The U.S. District Court for the Southern District of Texas' July 2009 grant of summary judgment for Maersk failed to consider evidence of nonobviousness, the U.S. Court of Appeals for the Federal Circuit ruled Wednesday.
