Some Duties Upheld On Indian Steel Imports

Law360, New York (August 27, 2010, 5:32 PM EDT) -- A federal judge has upheld certain duties the U.S. Department of Commerce imposed on hot-rolled carbon steel flat products imported from India in 2007, but she remanded as to whether Essar Steel Ltd. benefited from one particular state-sponsored program.

Commerce applied adverse facts available when examining the benefit supposedly conferred on India-based Essar by the state of Chhattisgarh’s Industrial Program, according to Judge Judith M. Barzilay of the U.S. Court of International Trade, whose opinion was issued Aug. 19 and made public Thursday.
