Merck Faces Contract, IP Suit Over Dr. Scholl's Inserts

Law360, New York (August 27, 2010, 3:30 PM EDT) -- A Utah inventor and patent holder has accused Merck & Co. Inc. of breaching a licensing agreement for Dr. Scholl's-brand shoe inserts, then infringing a patent for the products by continuing to manufacture them after the agreement was terminated.

Edizone LLC lodged its complaint Thursday in the U.S. District Court for the District of Utah, claiming that Merck refused to mark its Dr. Scholl's products with U.S. Patent Number 6,865,759, which led the plaintiff to terminate the pharmaceutical giant's nonexclusive license for the technology in April...
