Eisai Wins Dismissal Of Apotex's Suit Over Aricept

Law360, New York (August 30, 2010, 3:34 PM ET) -- A federal judge has nixed Apotex Corp.'s declaratory judgment suit against Eisai Inc. over four patents for Alzheimer's disease drug Aricept, thwarting the plaintiff's attempt to begin selling a generic version when a key patent expires in November.

Judge James A. Beaty Jr. of the U.S. District Court for the Middle District of North Carolina granted Eisai's motion to dismiss the case Friday, finding that Apotex failed to show it had standing to pursue the case.
