AT&T Counterclaim Survives In $427M Coverage Suit

Law360, New York (August 30, 2010, 4:22 PM EDT) -- A federal judge has refused to dismiss AT&T Corp.'s counterclaim and motion for judgment on the pleadings in a dispute over a $427 million insurance claim for a settlement resolving litigation brought by the trustee of defunct Internet service provider At Home Corp.

In an opinion filed Friday, Judge Garrett E. Brown Jr. of the U.S. District Court for the District of New Jersey denied U.S. Specialty Insurance Co.'s motion to dismiss, finding that AT&T's counterclaim stated a “prima facie” case for insurance coverage.
