9th Circ. Nixes Challenge To Calif. Gas Pipeline

Law360, New York (September 10, 2010, 5:52 PM EDT) -- The U.S. Court of Appeals for the Ninth Circuit has rejected a bid by a pollution control agency for an environmental review of the Federal Energy Regulatory Commission's approval of a natural gas pipeline stretching through California.

The appeals court on Thursday denied a petition for review by the South Coast Air Quality Management District, the pollution control agency for Los Angeles and the surrounding counties, ruling that FERC adequately considered the environmental impact of the project.
