Fed. Circ. Trims $7.4M Award In Medtronic Patent Suit

Law360, New York (September 10, 2010, 6:21 PM EDT) -- A federal appeals court has overturned part of a $7.4 million award in a patent infringement suit against Medtronic Sofamor Danek Inc. over a spinal disk implant, finding that a lower court erred in allowing nonpracticing patent holder Spine Solutions Inc. to bootstrap its sister companies to the litigation.

The district court also made a mistake in making Medtronic pay SSI's attorneys fees, as Medtronic's infringement should not have been considered willful, a three-judge panel of the U.S. Court of Appeals for the Federal Circuit ruled...
