Bayer Wins Toss Of Expert Testimony In Trasylol MDL

Law360, New York (September 13, 2010, 2:08 PM EDT) -- Bayer Corp. has persuaded a federal judge to exclude portions of an expert's testimony for plaintiffs in the multidistrict litigation over the company's blood-clotting drug Trasylol.

Judge Donald M. Middlebrooks of the U.S. District Court for the Southern District of Florida on Friday issued his order partly granting Bayer's Daubert motion to exclude Doctor F. Gary Toback's report from the MDL, ruling that the nephrologist's opinion that Bayer did not adequately test Trasylol fell outside the realm of his expertise and constituted an inadmissible personal opinion....
