EU High Court Upholds In-House Counsel Privilege Rule

Law360, New York (September 14, 2010, 3:55 PM EDT) -- The European Union's highest court on Tuesday upheld its precedent that legal professional privilege does not cover communications with in-house counsel during competition probes, rejecting efforts by Akzo Nobel Chemicals Ltd. and corporate counsel trade groups to overturn the current privilege standard.

The European Court of Justice denied Akzo's challenge to the European Commission's decision to seize two e-mails between the general manager for Akzo unit Akcros Chemicals Ltd. and the head of the company's competition law coordinator.
