Dreyer's Again Dodges Distributor's RICO, Tying Suit

Law360, New York (September 14, 2010, 2:42 PM EDT) -- Dreyer’s Grand Ice Cream Inc. has won the dismissal of a defunct ice cream distributor's lawsuit claiming that the company's exclusive distribution agreement violated racketeering and antitrust laws.

Judge Claudia Wilken of the U.S. District Court for the Northern District of California on Friday dismissed with prejudice Ice Cream Distributors of Evansville LLC’s lawsuit alleging Dreyer’s engaged in racketeering activity and restrained trade by pressuring it to stop distributing ice cream products made by competitors like Unilever.
