9th Circ. Limits Electronic Search In MLB Steroid Case

Law360, New York (September 15, 2010, 5:26 PM EDT) -- A full federal appeals court has overturned a panel decision upholding the government’s search of a computer database and other records in its investigation of steroid use by professional baseball players, establishing new ground rules for the search and seizure of electronically stored information.

The U.S. Court of Appeals for the Ninth Circuit ruled en banc on Monday that a three-judge panel had erred when it defended aspects of a government search of drug testing records at the facilities of Comprehensive Drug Testing Inc.
