Whirlpool Can't Wash Hands Of Moldy Machine Claims

Law360, New York (September 17, 2010, 5:01 PM EDT) -- Whirlpool Corp. has failed in its most recent bid to trim claims from multidistrict litigation alleging three of its front-loading washing machine models accumulate mold and infuse clothing with a mildewy smell.

Judge James Gwin of the U.S. District Court for the Northern District of Ohio on Wednesday denied the home appliance giant's bid to dismiss fraud-related claims from the litigation, saying that the consumers plaintiffs' amended complaint adequately alleged a fraud-by-partial-omission theory under various states' consumer protection statutes.
