Japan Seeks To Reverse Ontario Green Subsidy

Law360, New York (September 17, 2010, 3:49 PM EDT) -- Japanese trade officials have requested WTO consultation regarding an Ontario, Canada, clean energy program they say discriminates against Japanese exporters of wind and solar technology.

Ontario’s feed-in-tariff program sets fixed prices on electricity generated within the province from renewable sources, provided that a certain percentage of all goods and services used in those programs comes from within the province.

But those twin provisions amount to an illegal subsidy under the GATT agreement, according to an official Japanese request for World Trade Organization consultation delivered to Ottawa...
