11th Circ. Rules Shuttle Drivers Exempt From OT Wages

Law360, New York (September 22, 2010, 1:33 PM EDT) -- Weighing in on the case for the second time, a federal appeals court has ruled that airport shuttle drivers in a Florida class action are exempt from overtime pay under the Fair Labor Standards Act because aspects of their job can be considered interstate commerce.

The U.S. Court of Appeals for the Eleventh Circuit issued the ruling Tuesday, dealing a potentially fatal blow to the plaintiffs' hopes of recovering overtime wages they say were improperly denied by Southern Shuttle Services Inc.
