OJ Bottler Sues Coke Over Bottle Design Patents

Law360, New York (September 23, 2010, 2:25 PM EDT) -- Johanna Foods Inc., which packages orange juice for supermarket chain Aldi Inc., has sued The Coca-Cola Co., seeking a judgment that its carafe-style plastic bottles do not infringe the soft drink giant's design patents.

Johanna filed suit Tuesday in the U.S. District Court for the District of New Jersey, claiming that Coca-Cola does not have valid trade dress rights on the bottles, which it uses to sell orange juice through its Simply Orange Juice Co. unit.
