GAO Backs Vanguard Protest Over FEMA Contracts

Law360, New York (September 23, 2010, 3:12 PM EDT) -- The U.S. Government Accountability Office has sustained a bid protest brought by Vanguard Recovery Assistance, finding that the Federal Emergency Management Agency's methodology for scoring the company's past performance penalized it for submitting certain less-relevant references.

In a decision released to the public Thursday, the GAO found that in re-evaluating the past performance of offerors for four indefinite delivery/ indefinite quantity contracts for architectural/ engineering services, FEMA used a numerical scoring system that penalized Vanguard for submitting additional information.
