Judgment Overturned In Gas Tank Patent Dispute

Law360, New York (March 1, 2007, 12:00 AM EST) -- An appellate court on Wednesday overturned a summary judgment ruling in two fueling equipment makers’ patent dispute over petroleum storage tanks.

The U.S. Court of Appeals for the Federal Circuit overturned a district court’s ruling that a product manufactured by Dover Corp.’s OPW Fueling Components did not infringe on a patent owned by Franklin Electric Co. Inc. The appellate court remanded the case to the district court for further consideration.
