Fred Meyer Workers Win Initial Class Cert. In OT Suit

Law360, New York (September 24, 2010, 5:52 PM EDT) -- A federal judge has granted conditional certification to a class of loss-prevention managers who allege their employer Fred Meyer Stores Inc. misclassified them as exempt from the Fair Labor Standards Act’s overtime provisions.

Judge Anna J. Brown of the U.S. District Court for the District of Oregon ruled Thursday that named plaintiff Elburn Templeton could move forward with his complaint after meeting the necessary criteria for a class action designation.
