Potash Wins Discovery Bid In Suit Over BHP Deal

Law360, New York (September 27, 2010, 3:02 PM EDT) -- A federal judge Monday overlooked opposition from BHP Billiton Ltd. in granting a motion for speedy discovery in Potash Corp. of Saskatchewan Inc.'s lawsuit seeking to halt BHP's $43 billion hostile takeover offer, which has drawn antitrust scrutiny from Canadian officials.

Judge David H. Coar decided from the bench in favor of Potash's request for documents in the U.S. District Court for the Northern District of Illinois, despite BHP's claim that the move was “blunderbuss” and a “full-fledged fishing expedition.”
