EPA Slaps 4 Ethanol Plant Operators With CAA Suit

Law360, New York (September 28, 2010, 12:42 PM EDT) -- The U.S. Environmental Protection Agency has accused the owners and operators of three South Dakota ethanol plants of spewing excessive hazardous air pollutants, beyond the amount allowed by their operating permits, in violation of the Clean Air Act.

The U.S. Department of Justice lodged two suits on behalf of the EPA in the U.S. District Court for the Southern District of South Dakota on Monday, targeting Dakota Ethanol LLC in one and James Valley Ethanol LLC, Northern Lights Ethanol LLC and Poet Plant Management in another....
