Subcontractor Exec Pleads Not Guilty In DOD Fraud

Law360, New York (September 30, 2010, 2:12 PM EDT) -- A Superior Metal Powders Inc. executive has pled not guilty to charges alleging that he and fellow military subcontractors sold $42 million worth of aircraft flares to the Department of Defense that were illegally made using magnesium from China.

Justin Magness, vice president of Superior Metal Powders, waived his right to appear at Tuesday's arraignment in the U.S. District Court for the Western District of New York and entered a plea of not guilty through his attorney.
