Merck Balks At $4.6M Verdict In Mass. Medicaid Case

Law360, New York (September 30, 2010, 7:28 PM ET) -- Merck & Co. Inc. vowed Thursday to fight a $4.6 million jury verdict against the drugmaker in a suit alleging that a defunct subsidiary of Schering-Plough Corp. — which is now owned by Merck — reported inflated prices for albuterol to the Massachusetts Medicaid program.

A jury in the U.S. District Court for the District of Massachusetts on Thursday awarded the state damages in the amount of $4.56 million following a three-week trial.
