Arbitron Escapes From Radio Station's Antitrust Suit

Law360, New York (October 7, 2010, 4:25 PM EDT) -- Media research company Arbitron Inc. has won its bid for dismissal from a Mississippi radio station's $9.5 million suit accusing it and Clear Channel Communications Inc. of conspiring to silence industry competition.

Judge Keith Starrett dismissed Arbitron from the suit without prejudice in the U.S. District Court for the Southern District of Mississippi on Wednesday, ruling that WZKX (FM)'s complaint fell “far short” of the pleading standard established by the U.S. Supreme Court in its landmark Twombly decision.
