T3 Fights To Revive IBM Antitrust Claims In 2nd Circ.

Law360, New York (October 7, 2010, 4:52 PM EDT) -- A federal appeals court is weighing whether mainframe system provider T3 Technologies Inc. can bring antitrust claims in a now-settled patent battle between IBM Corp. and a former T3 supplier.

Mark A. Lemley of Durie Tangri LLP faced tough questioning on Thursday from a panel in the U.S. Court of Appeals for the Second Circuit as he tried to revive antitrust claims against IBM that were thrown out for lack of standing.
