Highlighting The Need For Written Subcontracts

Law360, New York (October 8, 2010, 6:05 PM EDT) -- A recent decision highlights what may seem like a basic best practice in government contracting: use written subcontracts!

Although this admonition rarely comes into play in traditional prime/ sub relationships where written agreements are standard fare, it may be an issue in rare cases where the government asks a prime contractor to place work with a specific subcontractor as an accommodation to the government — either for administrative ease or because the third party offers essential services but lacks an appropriate contract vehicle.
