Supreme Court To Hear Gov't Worker Retaliation Suit

Law360, New York (October 12, 2010, 6:05 PM EDT) -- The U.S. Supreme Court has agreed to rule on whether the First Amendment’s petition clause protects public workers against retaliation by employers when they petition the government to resolve private issues.

The nation’s high court on Tuesday granted a petition for writ of certiorari lodged by the government of a northeast Pennsylvania borough seeking to overturn a ruling that a local police chief could sue his employer for retaliation, even though his claims didn’t involve matters of public concern.
