Antitrust Suit: Purdue Pharma Tricked PTO

Law360, New York (March 8, 2007, 12:00 AM EST) -- A drug wholesaler has filed an antitrust class action over the painkiller OxyContin, accusing the defendants of deceiving the U.S. Patent and Trademark Office to gain a monopoly on the U.S. market for the drug and using three fraudulently obtained patents to stifle competition and keep generic versions of the drug off the market.

The lawsuit was filed Tuesday in federal court in Manhattan by the Harvard Drug Group LLC against Purdue Pharma L.P., The Purdue Frederick Company, The Purdue Pharma Company and P.F. Laboratories Inc....
