Insurers Lose Appeal To Contest Harsh Texas Report

Law360, New York (October 18, 2010, 3:59 PM EDT) -- A Texas appeals court has barred two insurance companies from challenging an examination commissioned by the Texas Department of Insurance that alleged illegal practices, ruling that their claims for declaratory relief were barred by sovereign immunity and were not ripe.

The Third Court of Appeals of Texas affirmed a lower court's decision against American Southwest Insurance Managers Inc. and also ruled that Old American County Mutual Fire Insurance Co. could not intervene in the case, according to an opinion Friday by Judge Diane M. Henson....
