Circuit Hears Washington's Liquor Antitrust Case

Law360, New York (March 9, 2007, 12:00 AM EST) -- A circuit court heard arguments Thursday on whether state regulations on alcohol violate federal antitrust laws in a case that could put several states’ liquor restrictions at risk.

Ninth Circuit Judges Diarmuid O'Scannlain, Wallace Tashima and Marsha Berzon “asked tough questions” in the hearing, which has garnered nationwide attention. Twenty-four states have filed amicus briefs in support of the state of Washington against Costco Wholesale Corp., said David Hankins, assistant attorney general for the state of Washington.
