Ex-Duane Reade CEO Asks For Lighter Sentence

Law360, New York (October 19, 2010, 1:48 PM EDT) -- Former Duane Reade CEO and convicted securities and real estate fraudster Anthony Cuti has told a judge that his crimes caused no loss to anyone, and that the loss-enhancement factored into a probation officer’s presentence report is draconian and unwarranted.

The 22-level loss enhancement included in the presentence report would yield a prison term of between 17 and 22 years under federal guidelines, according to Cuti’s sentencing memorandum filed Monday in the U.S. District Court for the Southern District of New York.
